Tirol Lodge Ellmau – Morgenpost Gewinnspiel

  

  1. Gegenstand der Teilnahmebedingungen

Sämtliche Informationen im Rahmen dieses Gewinnspiels werden ausschließlich seitens des Veranstalters bereitgestellt. Instagram und Facebook stehen in keiner wie auch immer gearteten Verbindung zu diesem Gewinnspiel und sponsern, unterstützen oder organisieren dieses Gewinnspiel nicht. Es bestehen daher keinerlei Rechtsansprüche gegenüber Instagram und Facebook.

 

  1. Veranstalter

Veranstalter des Gewinnspiels ist Tirol Lodge Ellmau, Bergbahnen Ellmau-Going Touristik Gmbh, Weissachgraben 5, 6352 Ellmau (nachfolgend Veranstalter).

 

  1. Teilnahmeberechtigung

Teilnahmeberechtigt sind alle volljährigen Personen.

Die Teilnahme an diesem Gewinnspiel richtet sich nach den nachfolgenden Teilnahmebedingungen, die durch die Teilnahme automatisch anerkannt werden.

 

  1. Teilnahmeausschluss

Ausgeschlossen von der Teilnahme sind Angestellte, freie Mitarbeiter und Bevollmächtigte des Veranstalters sowie Bevollmächtigte etwaiger Kooperationspartner. Ein Verstoß hiergegen führt zum Ausschluss des betreffenden Teilnehmers vom Gewinnspiel. Ausgeschlossen werden auch Teilnehmer, die sich unerlaubter Hilfsmittel bedienen, in sonstiger Weise versuchen, das Gewinnspiel zu manipulieren oder gegen diese Teilnahmebedingungen verstoßen. Der Veranstalter behält sich vor, in diesen Fällen auch nachträglich Gewinne abzuerkennen und zurückzufordern.

 

  1. Inhalt des Gewinnspieles und Gewinnaussicht

Die Teilnahme am Gewinnspiel erfolgt, indem der User sein schönstes Urlaubsbild, Video oder Reel von seinem Urlaub in der Tirol Lodge Ellmau auf Instagram als Feed-Beitrag (keine Story!) veröffentlicht und den Kanal @tirol_lodge markiert, sowie den Hashtag #ilovemylodge verwendet. Das Instagram-Profil des Teilnehmers muss ein öffentlicher Account sein, sodass die Beiträge zur Gewinnerermittlung eingesehen werden können. Jeden Monat wird unter allen markierten Beiträgen der schönste Post gekürt. Dieser gewinnt einen Gutschein für eine Nacht für zwei Personen in einem Doppelzimmer in der Tirol Lodge. Der Gutschein ist ausschließlich im Zeitraum zwischen dem 15.05.2024 und dem 30.07.2024 einlösbar.

 

  1. Teilnahme; Gewinnermittlung

Mit der Teilnahme erklärt sich der Nutzer einverstanden, dass er vom Veranstalter über die Messenger Dienste von Instagram kontaktiert wird, um über seinen Gewinn zu benachrichtigt zu werden. Sein Name darf im Falle des Gewinns in Form des ganzen Vornamens und dem ersten Buchstaben des Nachnamens verwendet werden. Der Gewinner hat den Erhalt der Gewinnbenachrichtigung unverzüglich, innerhalb von 14 Tagen gegenüber dem Veranstalter per Nachricht/E-Mail zu bestätigen. Gleichzeitig hat er die von dem Veranstalter in der Gewinnbenachrichtigung geforderten Informationen, insbesondere seinen Namen, seine E-Mail-Adresse und Anschrift, anzugeben. Diese Angaben dienen der Übersendung des Gewinns. Versäumt der Gewinner eine ordnungsgemäße Bestätigung der Gewinnbenachrichtigung, ist der Veranstalter berechtigt, eine Ersatzauslosung durchzuführen. Bei Sachpreisen ist die Auszahlung des entsprechenden Geldwertes oder ein Tausch nicht möglich. Der Gewinnanspruch ist nicht übertragbar. Pro Teilnehmer ist nur ein Hauptgewinn je Gewinnspiel möglich. Außerdem erklären sich Teilnehmer damit einverstanden, dass ein Gewinnerfoto auf den sozialen Kanälen sowie der Website des Veranstalters veröffentlich werden darf.

 

  1. Datenschutz

Die Tirol Lodge Ellmau, Bergbahnen Ellmau-Going Touristik Gmbh, Weissachgraben 5, 6352 Ellmau verarbeitet personenbezogene Daten zum Zwecke des Gewinnspiels auf Basis Ihrer Einwilligung gemäß Art. 6 Abs. 1 a EU-DSGVO.   1. Benachrichtigung der Gewinner

Die Gewinner werden jeweils bis zum dritten Werktag des Folgemonats per Instagram über den Gewinn informiert.

 

  1. Teilnahmefrist

Das Gewinnspiel beginnt mit Veröffentlichung des Gewinnspiels und der zugehörigen Bedingungen in der Tirol Lodge Morgenpost jeweils zum ersten Tag eines Monats und endet am jeweils letzten Tag desselben Monats.

 

  1. Haftungsausschluss / Änderung und vorzeitige Beendigung des Gewinnspiels

Der Veranstalter haftet nicht für etwaige Übertragungsfehler. Der Veranstalter behält sich vor, das Gewinnspiel jederzeit, auch ohne Einhaltung von Fristen, ganz oder teilweise vorzeitig zu beenden oder in seinem Verlauf abzuändern, sofern es aus technischen (z.B. Computervirus, Manipulation von oder Fehler in Software und Hardware) oder rechtlichen Gründen nicht möglich ist, das Gewinnspieles ordnungsgemäß durchzuführen.

 

  1. Haftungsausschluss Tirol Lodge Ellmau

Weder die Tirol Lodge Ellmau, Bergbahnen Ellmau-Going Touristik Gmbh noch die freigestellten Parteien oder ein Preisanbieter übernehmen die Verantwortung für Fehler, Fehlfunktionen, Schäden, Haftungsansprüche, Verluste oder Enttäuschungen, die einem Teilnehmer aus der Teilnahme am Wettbewerb oder der Annahme eines Preises entstehen, es sei denn, diese sind durch Fahrlässigkeit von Tirol Lodge Ellmau, Bergbahnen Ellmau-Going Touristik Gmbh oder einem Preisanbieter, seiner Mitarbeiter, Vertreter oder anderer Personen verursacht worden, soweit dies gesetzlich zulässig ist. Weder Tirol Lodge Ellmau, Bergbahnen Ellmau-Going Touristik Gmbh noch ein Preisanbieter übernimmt die Verantwortung oder Haftung für Stornierungen, Verspätungen oder andere Änderungen durch Unternehmen oder Personen, die Elemente des Wettbewerbs aus Gründen bereitstellen, die außerhalb der Kontrolle von Tirol Lodge Ellmau, Bergbahnen Ellmau-Going Touristik Gmbh oder einem Preisanbieter liegen, und ist nicht verantwortlich oder haftbar für Ausgaben, die als Folge davon entstehen. Die freigestellten Parteien sind nicht verantwortlich für Telekommunikations-, Netzwerk-, elektronische, technische oder Computerausfälle jeglicher Art, für die unzutreffende Transkription von Einsendeinformationen, für menschliches oder elektronisches Versagen oder für Einsendungen, die gestohlen, fehlgeleitet, verstümmelt, verzögert, verloren, verspätet, beschädigt oder zurückgegeben werden.

 

  1. Schlussbestimmungen

Es gilt das Recht der Bundesrepublik Deutschland. Der Rechtsweg ist ausgeschlossen.

  1. Subject of the conditions of participation

All information in this competition is provided solely by the Promoter. Instagram and Facebook have no connection whatsoever with this competition and do not sponsor, support or organise this competition. There are therefore no legal claims whatsoever against Instagram and Facebook.

 

  1. Organiser

The organiser of the competition is Tirol Lodge Ellmau, Bergbahnen Ellmau-Going Touristik Gmbh, Weissachgraben 5, 6352 Ellmau (hereinafter referred to as the organiser).

 

  1. Eligibility

All persons of legal age are eligible to participate.

Participation in this competition is subject to the following conditions of participation, which are automatically accepted by participation.

 

  1. Exclusion of participation

Employees, freelancers and authorised representatives of the organiser as well as authorised representatives of any cooperation partners are excluded from participation. Any infringement of this will lead to the exclusion of the participant concerned from the competition. Participants who use unauthorised aids, attempt to manipulate the competition in any other way or violate these conditions of participation will also be excluded. In such cases, the organiser reserves the right to disallow and reclaim prizes at a later date.

 

  1. Content of the competition and chances of winning

Participation in the competition takes place by the user posting their best holiday picture, video or reel from their holiday at Tirol Lodge Ellmau on Instagram as a feed post (not a story!) and tagging the channel @tirol_lodge, as well as using the hashtag #ilovemylodge. The participant’s Instagram profile must be a public account so that the posts can be viewed to determine the winner. Each month, the most beautiful post will be chosen from all tagged posts. The winner will receive a voucher for one night for two people in a double room at the Tirol Lodge. The voucher can only be redeemed between 15.05.2024 and 30.07.2024.

 

  1. Participation; prize determination

By entering, the user agrees to be contacted by the Promoter via Instagram’s messenger services to be notified of their prize. His or her name may be used in the form of the full first name and the first letter of the last name in the event that he or she wins. The winner must confirm receipt of the prize notification to the Promoter by message/email immediately, within 14 days. At the same time, the winner must provide the information requested by the Promoter in the prize notification, in particular his/her name, e-mail address and postal address. This information will be used to send the prize. If the winner fails to duly confirm the prize notification, the organiser is entitled to conduct a substitute draw. In the case of non-cash prizes, payment of the corresponding cash value or an exchange is not possible. The right to win is not transferable. Only one main prize per participant is possible per competition. In addition, participants agree that a winning photo may be published on social channels and the organiser’s website.

 

  1. Data protection

Tirol Lodge Ellmau, Bergbahnen Ellmau-Going Touristik Gmbh, Weissachgraben 5, 6352 Ellmau processes personal data for the purpose of the competition on the basis of your consent pursuant to Art. 6 (1) a EU-DSGVO.   1. Notification of winners

Winners will be notified of their win via Instagram by the third working day of the following month.

 

  1. Entry period

The competition begins with the publication of the competition and the associated conditions in the Tirol Lodge Morgenpost on the first day of each month and ends on the last day of the same month.

 

  1. Exclusion of liability / change and premature termination of the competition

The Organiser is not liable for any transmission errors. The organiser reserves the right to prematurely terminate the competition in whole or in part at any time, even without observing deadlines, or to change its course if it is not possible for technical reasons (e.g. computer virus, manipulation of or errors in software and hardware) or legal reasons to carry out the competition properly.

 

  1. Disclaimer Tirol Lodge Ellmau

Neither Tirol Lodge Ellmau, Bergbahnen Ellmau-Going Touristik Gmbh nor any Released Party or any Prize Provider accepts any responsibility for any error, malfunction, damage, liability, loss or disappointment suffered by any entrant as a result of entering the Competition or accepting any Prize, unless caused by the negligence of Tirol Lodge Ellmau, Bergbahnen Ellmau-Going Touristik Gmbh or any Prize Provider, its employees, agents or others to the fullest extent permitted by law. Neither Tirol Lodge Ellmau, Bergbahnen Ellmau-Going Touristik Gmbh nor any prize provider accepts responsibility or liability for any cancellations, delays or other changes caused by companies or persons providing elements of the competition for reasons beyond the control of Tirol Lodge Ellmau, Bergbahnen Ellmau-Going Touristik Gmbh or any prize provider and shall not be responsible or liable for any expenses incurred as a result. The failure of Tirol Lodge Ellmau, Bergbahnen Ellmau-Going Touristik Gmbh to comply with any provision of these Rules due to acts of God, hurricane, pandemic, war, fire, riot, earthquake, terrorism, acts of public enemies, acts of governmental authorities beyond the control of Tirol Lodge Ellmau, Bergbahnen Ellmau-Going Touristik Gmbh (other than compliance with applicable codes and ordinances), or other „force majeure“ events shall not be deemed a breach of these Rules. The Released Parties are not responsible for telecommunications, network, electronic, technical or computer failures of any kind, inaccurate transcription of entry information, human or electronic error, or entries that are stolen, misdirected, mutilated, delayed, lost, late, damaged or returned.

 

 

  1. Final provisions

The law of the Federal Republic of Germany applies. Legal recourse is excluded.
